These General Sales Conditions concern the purchase of products made remotely via the telematic network on the sitewww.yourfutureacademy.it, of the company

(hereinafter referred to as “YOURFUTUREACADEMY”) and any natural person, legal entity, and/or sole proprietorship and company (hereinafter “Customer”).

Each purchase operation will be governed by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; the information aimed at concluding the contract will be subject to Article 12 of Legislative Decree 70/03 and, regarding the protection of privacy, will be subject to the regulations of Legislative Decree 196/03. Any changes or new sales conditions will be promptly communicated to the Customer, will be effective from the moment of publication on the site, and will apply only to sales concluded after the publication.

Subject of the contract

With these General Terms and Conditions of Sale, YOURFUTUREACADEMY sells to the Customer, who purchases remotely, the products indicated and offered on the Site www.yourfutureacademy.it. The contract is concluded exclusively through the internet, by placing an order by the Customer according to the procedure provided on the Site.

The Customer, at the time of purchase, reviews the characteristics of the goods that are illustrated in the individual Product sheets and declares to have been specifically informed, among other conditions, especially regarding: Order; Product Price with details of shipping costs, VAT, and other applicable taxes, and any other costs; Payment methods; Right of withdrawal; Warranties; Applicable law and competent court.

The submission of the purchase order by the Customer implies full knowledge and express acceptance of these General Terms and Conditions of Sale.

The Customer is required to verify with the utmost attention and care the correctness of their data contained in the purchase order and to promptly communicate to YOURFUTUREACADEMY any corrections thereof.

The Customer, if a natural person, who places an order through the Site, declares and guarantees that they are of legal age (18 years) and have the legal capacity to enter into binding contracts.

In any case, the Customer is prohibited from entering false, invented, or fictitious names in the ordering procedure and in further communications to YOURFUTUREACADEMY, which reserves the right to take legal action against any violation and abuse. The Customer must pay particular attention when filling out the order form, as YOURFUTUREACADEMY cannot be held responsible for data deemed incorrect by the Customer if such information has been submitted by them.

Order

The Customer proceeds to order the purchase of YOURFUTUREACADEMY Products through a request made directly on the Site, following the indicated procedures, both in filling out personal or business data and in the payment method. The personal data provided for payment will be processed by YOURFUTUREACADEMY to fulfill the order request and related invoicing.

Once the contract is concluded, YOURFUTUREACADEMY will send the Customer, via email, an order confirmation containing a summary of the information already included in the order itself.

The Customer can purchase the products available on the site at the time of submitting the order as described in the relevant information sheets. The images on the site are indicative and are provided to the Customer to facilitate product recognition.

The Order is executed within the terms specified on the summary page and in the Order Confirmation email, subject to the availability of the ordered product.

In the event of submitting the order form with payment and unavailability of the product or if YOURFUTUREACADEMY is unable to fulfill the order, the amount advanced by the Customer will be refunded immediately.

Product and Shipping Prices

All prices on the site, expressed in Euros (€), are to be understood as including VAT (22%), which will be automatically calculated in the cart at the time of purchase. YOURFUTUREACADEMY reserves the right to change prices at any time without prior notice.

The cost of shipping, not included in the price of the Products, is the responsibility of the Customer, except in the case of specific offers for free shipping costs clearly stated on the site.

The cost of shipping is calculated based on the shipping method chosen by the Customer, the destination indicated by them, and the number of packages, and is provided at the time of the order when the data to estimate them is available.

For sales abroad (excluding Italy): retail prices do not include any taxes, shipping costs, duties, and taxes applicable in the destination country of the products. Such costs, which vary from country to country, are the responsibility of the customer and will be calculated in a specific informative email.

Payment Methods

The Customer can purchase the products available on the site using various payment methods, as indicated in the purchasing procedure: Paypal system, credit card, bank transfer, immediate transfer.

Any additional costs related to a specific payment method will be explicitly highlighted during the purchasing procedure.

Payment data and communications occur over secure lines and with all guarantees provided by the use of security protocols required by electronic payment circuits.

Delivery Methods

YOURFUTUREACADEMY delivers its products in Italy and abroad through specialized couriers. For deliveries abroad, any potential costs (shipping and duties) will be communicated via specific emails depending on the destination country of the goods. Shipping costs in Italy are calculated based on the shipping method chosen by the Customer, the destination indicated by them, and the number of packages, and are indicated at the time of the order when the data to estimate them is available.

Upon receiving the goods, the Customer is required to verify their integrity. If the customer has doubts about their integrity, they must indicate it on the delivery receipt. The customer will have 14 days to verify the integrity of the goods and communicate any damages in writing via email to info@yourfutureacademy.it. Within 14 working days, YOURFUTUREACADEMY will refund the customer (as provided in the withdrawal methods) or resend intact goods of equal value and quality, in case the Customer opts for this last solution.

For the purchase of the online course, the customer will be able to access it only when it is not present on the website.

Warranty

Pursuant to Article 130 of the Consumer Code, YOURFUTUREACADEMY is responsible to the Customer for any conformity defect existing at the time of delivery of the goods; in this case, the Customer has the right to restore, at no cost, the conformity of the goods through repair or replacement, in accordance with paragraphs 3, 4, 5, and 6 of Article 130 of the Consumer Code, or to an adequate reduction of the price or to the resolution of the sales contract, in accordance with paragraphs 7, 8, and 9 of Article 130 of the Consumer Code.

YOURFUTUREACADEMY notes that, pursuant to paragraph 10 of Article 130 of the Consumer Code, a minor conformity defect for which it was not possible or is excessively burdensome to pursue the remedies of repair or replacement does not entitle the resolution of the contract.

As stated in Article 132 of the Consumer Code, YOURFUTUREACADEMY is responsible for the situation better described in the previous point where the conformity defect manifests itself within two years from the delivery of the good: in this regard, YOURFUTUREACADEMY also observes that, pursuant to paragraph 2 of Article 132 of the Consumer Code, the so-called Consumer Customer loses the rights provided for in Article 130 paragraph 2 of the Consumer Code if they do not report the conformity defect to the seller within 2 months from the date they discovered it.

In order to benefit from the warranty better illustrated in the previous points, the Consumer Customer is unconditionally required to provide the so-called "proof of purchase" as well as proof of the actual delivery of the goods by YOURFUTUREACADEMY.

In the event that the Customer is a professional as defined by Article 3 paragraph 1 letter c) of the Consumer Code, they have the right to avail themselves of the so-called "legal" warranty provided by the current Italian civil code, which states that it is valid for a period of 1 year from the delivery of the product, provided that, under penalty of forfeiture, the so-called "professional" Customer has reported the relevant conformity defect within 8 days from its discovery.

The products offered for sale by YOURFUTUREACADEMY on its website comply with current Italian national legislation or community legislation; the images and colors of the goods for sale on YOURFUTUREACADEMY's website are to be understood as indicative and illustrative, with the consequence that the Customer (whether a so-called “Consumer” or a so-called “Professional”) is required to refer exclusively to the characteristics described in the technical data sheet (where available) of the relevant product: therefore, any inaccuracies or non-substantial differences between what is represented on YOURFUTUREACADEMY's website and the product delivered to the Customer are not to be considered a contractual breach.

Delivery times are those indicated in the purchase order and specified in the purchase order confirmation and may vary based on the destination, type of product, amount, and volume of the goods.

YOURFUTUREACADEMY will not be responsible for delays caused by incorrect communication of addresses and other information necessary to deliver the Products.

At the time of delivery of the Products to the Customer by the carrier responsible for their transport, the Customer must check, in the presence of the carrier, that:

a) the quantity and type of the ordered Products correspond to what is indicated in the transport document;

b) the packaging used for transport is intact, undamaged, or otherwise unaltered, even just in the sealing materials.

c) the quantity and type of the delivered Products correspond to what was ordered.

In the event that the package shows obvious signs of tampering or alteration, the Customer must notify YOURFUTUREACADEMY by email and/or registered letter within the next 24 hours.

For every order placed on the site, YOURFUTUREACADEMY will issue an invoice for the shipped goods, sent via email or by mail to the order holder or included in the package shipped to the Customer.

At the time of shipment of the goods, YOURFUTUREACADEMY will send the Customer an email or SMS with the tracking information, indicating the shipment code and details related to the courier.

Applicable law and competent court

The sales contract concluded according to these General Conditions is considered concluded in Italy and governed by Italian law. Any dispute regarding the interpretation, execution, or validity of the sales contract concluded through the Site will be subject to the exclusive jurisdiction of the Court of Bari.

Website content and intellectual property rights

The contents of the Site, the works, the images, the photographs, the dialogues, the music, the videos, the documents, the drawings, the figures, the logos, and any other material published on the Site are protected by copyright and by any other intellectual property rights of YOURFUTUREACADEMY and other rights holders. Reproduction, modification, duplication, copying, or any exploitation of the images and contents of the Site is prohibited unless previously authorized in writing by YOURFUTUREACADEMY.

Processing of personal data

Customer data is processed by YOURFUTUREACADEMY in accordance with the provisions of the regulations on personal data protection, as further specified in the information available in the dedicated Privacy Policy section on the Site.
